Activity - Creating A Will

Naming A Guardian For Your Child
During a cheerful and exciting time such as pregnancy, it is hard to take the time to think through uncomfortable and tragic situations such as the death of you and your partner.  However, as difficult as it may be, sitting down and discussing your wishes with your partner can be a very valuable exercise prior to the birth of your baby.  Thinking through whom you and your partner would like to care for your child in your absence, although not easy, is sometimes therapeutic. It can be comforting to know, regardless of an unfortunate accident, that your baby will still be well cared for and loved.

  Creating A Will
Once you and your partner have decided on a guardian for your child, it is also important to have a legal will created.  If only you and your partner know your wishes and something should happen to both of you, the state would appoint a guardian for your child based on their knowledge of your family and not necessarily your intentions.  On the other hand, with a legal will, your guardian request would be upheld and your child would be given to whomever is named.

Again, while an uncomfortable time to think through the worst case scenario, pregnancy is actually a very good time to research how to go about creating a legal will in your state.  You and your partner will likely be overwhelmed and sleep-deprived the first couple of months your new baby is home with you, making it a less than ideal time to go through the will creation process then.  Consider contacting a local lawyer and discussing your will options, or there is computer software available that can help you create your will following a step-by-step process.
